Terms & Conditions:

These Terms and Conditions ("Terms") govern the relationship between HerHustle Marketing Agency ("we," "us," or "our") and you, the client ("you" or "Client"). By engaging our services, you agree to the following terms.

Services Provided

HerHustle offers marketing services, including but not limited to:

  • Strategy development

  • Social media management

  • Branding and design

  • Paid advertising campaigns

  • Content creation

 

The scope of work will be outlined in a written agreement or proposal approved by both parties before work begins.

 

Fees and Payment Terms

  • All fees will be clearly stated in the proposal or contract.

  • Payment is due as outlined in the invoice schedule, typically requiring a deposit (e.g., 50%) before work begins and the balance upon project completion.

  • Late payments will incur a fee of 2% of the invoice total per month overdue.

  • Non-payment beyond 90 days will result in the suspension of services and may lead to legal action to recover unpaid amounts.

Client Responsibilities

To ensure the success of the project, you agree to:

  • Provide accurate and complete information and materials on time.

  • Respond to our queries and requests promptly.

  • Approve or reject deliverables within agreed timelines.

 

Failure to meet these responsibilities may result in delays, additional fees, or termination of the agreement.

Intellectual Property

  • Upon full payment, you will own the final deliverables as outlined in the agreement.

  • We retain the right to use project work in our portfolio or marketing materials unless you request otherwise in writing.

  • All draft work, concepts, and unused designs remain the property of HerHustle.

Confidentiality

Both parties agree to keep all proprietary information shared during the engagement confidential unless required by law or expressly permitted in writing.

Revisions and Additional Work

  • The agreement includes a set number of revisions, as stated in the proposal. Additional revisions will incur extra charges.

  • Any requests beyond the original scope of work will be considered additional work and charged at our standard hourly rate unless otherwise agreed.

Cancellations and Refunds

  • Either party may terminate the agreement with 14 days' written notice.

  • If you cancel after work has commenced, you will be responsible for payment for work completed up to the cancellation date.

  • Deposits are non-refundable.

Limitation of Liability

  • While we strive to deliver high-quality results, we cannot guarantee specific outcomes (e.g., increased sales or followers).

  • HerHustle will not be held liable for any indirect, incidental, or consequential damages arising from our services.

Dispute Resolution

  • In the event of a dispute, both parties agree to attempt to resolve it through negotiation.

  • If unresolved, disputes will be subject to mediation in Brisbane, Australia.

  • If mediation fails, either party may seek legal action, with jurisdiction in Queensland, Australia.

Force Majeure

We are not responsible for delays or failure to perform due to circumstances beyond our control, including but not limited to natural disasters, pandemics, or government actions.

Amendments

We reserve the right to update these Terms at any time. Clients will be notified of significant changes.

Acceptance

By engaging our services, you acknowledge that you have read, understood, and agree to these Terms.
